Terms of Service

These Terms of Service ("Terms") form a legally binding agreement between you ("you," "your," or "User") and the owner and operator of Keph (keph.me) ("Keph," "we," "us," "our," or the "Operator"). Please read these Terms carefully. They contain important provisions that limit our liability, require you to assume risk, and govern how disputes are resolved.

1. Acceptance and Eligibility

By accessing, browsing, or using Keph in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and, where applicable, The Covenant (defined below). If you do not agree to all of these, you must not access or use the service.

Keph is intended exclusively for adults. You represent and warrant that you are at least eighteen (18) years of age, or the age of legal majority in your jurisdiction if higher, and that you have the full legal capacity to enter into these Terms. By passing the age gate presented on first visit and by using the service, you affirm and acknowledge that you meet these age requirements. If you are not of legal age, you must not access or use Keph in any manner.

2. Nature of the Service

Keph is an AI-powered conversational service. Responses are generated by third-party large language models and AI infrastructure providers that we may select, combine, or change from time to time at our sole discretion, without notice. The content produced by these models is generated automatically and algorithmically.

AI-generated content is not authored, written, reviewed, verified, endorsed, approved, or adopted by Keph or its Operator. Such content may be inaccurate, incomplete, outdated, misleading, offensive, explicit, disturbing, biased, or simply wrong. All outputs are provided strictly for informational and educational purposes only. Nothing generated by the service constitutes professional advice of any kind — it is not legal, medical, financial, psychological, safety, or other professional advice, and must not be relied upon as such. You are solely responsible for independently evaluating and verifying the accuracy, completeness, legality, and suitability of any content before relying on or acting upon it. For any matter of importance, consult a qualified licensed professional.

3. Unfiltered Content, the Acknowledgment, and The Covenant

Keph provides a single conversational experience that is intentionally raw and unfiltered. Responses may be unrestricted, explicit, disturbing, or otherwise unsuitable for some audiences, and are provided only to adults who have accepted these Terms. Before your first message, the service requires an explicit consent step:

The Covenant is a binding supplemental agreement incorporated into and made part of these Terms by reference. By confirming the acknowledgment or signing The Covenant, you make a deliberate, informed, and voluntary choice to receive unfiltered content, and you reaffirm every representation, waiver, release, and assumption of risk set out in these Terms and in The Covenant. In the event of any conflict, the terms of The Covenant control to the extent they provide the Operator broader protection.

4. Assumption of Risk

You understand and agree that use of Keph carries inherent risks. By using the service, you knowingly, voluntarily, and freely assume any and all risk arising from or related to such use, including, without limitation, exposure to unfiltered, explicit, inaccurate, or objectionable content, and any and all consequences of interpreting, relying upon, or acting upon any information or content received. You accept full responsibility for that risk and agree that the Operator bears no responsibility for it.

5. User Responsibility and Lawful Use

You are entirely and solely responsible for how you access, use, interpret, or act upon any output of the service, and for any actions you or others take based on such output. Keph is an informational tool only. Any decision you make based on AI-generated content is made at your own risk and in your sole discretion.

You agree to comply with all laws, regulations, and rules applicable to you in your jurisdiction. You must not use the service, or any content obtained through it, to plan, facilitate, encourage, enable, or commit any illegal, harmful, or unlawful act. The Operator does not encourage, endorse, solicit, or condone any illegal activity, and is not responsible or liable for any User's misconduct, misuse, or unlawful conduct.

6. Prohibited Conduct

You agree that you will not, and will not attempt to:

We reserve the right to investigate, suspend, or terminate access, and to cooperate with law enforcement, in response to any actual or suspected violation.

7. Release and Waiver of Liability

To the fullest extent permitted by applicable law, you hereby release, waive, discharge, and covenant not to sue Keph, its founder, owner, Operator, officers, employees, contractors, agents, affiliates, successors, and service providers (collectively, the "Released Parties") from and against any and all claims, demands, liabilities, damages, losses, costs, expenses, and causes of action of every kind and nature, whether known or unknown, arising out of or in any way related to your access to or use of the service, any mode of the service, or your reliance on or use of any content generated by it. This release applies whether such claims arise in contract, tort, statute, or otherwise, and includes claims based on the Operator's own alleged negligence, to the maximum extent the law allows.

8. Disclaimer of Warranties

The service and all content are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, the Released Parties disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty as to the accuracy, reliability, completeness, timeliness, availability, or suitability of any content generated through the service. No advice or information, whether oral or written, obtained from the service creates any warranty not expressly stated in these Terms.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the Released Parties be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of, or inability to use, the service or any content, including but not limited to damages for loss of profits, revenue, data, goodwill, or other intangible losses, regardless of the theory of liability and regardless of whether the Operator has been advised of the possibility of such damages.

Without limiting the foregoing, and to the extent any liability cannot be fully disclaimed, the total aggregate liability of the Released Parties for any and all claims arising out of or relating to the service or these Terms shall not exceed the greater of (a) the total amount you actually paid to Keph in the three (3) months immediately preceding the event giving rise to the claim, or (b) fifty United States dollars (USD $50).

10. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, damages, losses, liabilities, judgments, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your access to or use of the service; (b) your violation of these Terms, The Covenant, or any applicable law; (c) your violation of any rights of a third party; or (d) any content you submit to the service or act upon.

11. Accounts

You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating an account. We reserve the right to suspend or terminate accounts at our sole discretion, with or without notice.

12. Subscriptions and Payments

Paid membership is billed through PayPal on a recurring basis, at the prices and intervals (monthly or annual) shown at the point of purchase. New subscriptions may begin with a free trial period: your payment method is placed on file when you subscribe, and the subscription converts to a paid subscription automatically at the end of the trial unless you cancel before the trial ends. If you cancel during the trial, you will not be charged.

You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period (or trial), and you retain member access until that period ends. Prices, plans, and included features may change prospectively; changes do not affect a billing period already paid.

ALL PAYMENTS ARE FINAL. NO REFUNDS. Except where a refund is required by applicable law, all payments are non-refundable — in whole and in part — including for unused time in a billing period, dissatisfaction with the service, account suspension or termination for violation of these Terms, or discontinuation of the service. Your sole remedy is to cancel your subscription, which stops future billing.

12a. Service Availability; Right to Discontinue

Keph may be suspended, interrupted, or permanently shut down at any time, without notice. You acknowledge that, given the nature of the service — uncensored, AI-generated content for mature audiences — the service faces elevated operational risk: payment processors, AI model providers, hosting providers, app distribution platforms, or other third parties on which the service depends may restrict, suspend, or withdraw service at any time, and legal or regulatory action may require changes to or cessation of the service. The Operator may also modify, limit, or discontinue the service, in whole or in part, at its sole discretion for any reason or no reason.

To the fullest extent permitted by law, no such suspension, interruption, modification, or permanent shutdown shall give rise to any liability of the Released Parties or entitle you to any refund, credit, or compensation, except where a refund is required by applicable law. You are encouraged to export your conversation records periodically; the Operator has no obligation to preserve or return any data after the service ends.

13. Third-Party Services

Keph relies on third-party services to operate, including AI model and infrastructure providers, payment processors (PayPal), hosting and database providers, authentication providers (Google and Microsoft), and email delivery providers. Your use of the service may be subject to the terms and policies of those third parties, and content you submit may be processed by them under their own policies. The Operator does not control and is not responsible or liable for the acts, omissions, availability, or policies of any third-party service.

14. Dispute Resolution; Arbitration and Class Action Waiver

To the extent permitted by applicable law, you and the Operator agree that any dispute, claim, or controversy arising out of or relating to the service or these Terms shall be resolved through binding individual arbitration, rather than in court, except that either party may seek relief in a small-claims court for qualifying claims.

To the fullest extent permitted by applicable law, you and the Operator each waive any right to a trial by jury and agree that any proceeding will be conducted only on an individual basis and not as a plaintiff or class member in any purported class, collective, consolidated, or representative action. If applicable law does not permit a particular dispute or remedy to be resolved by arbitration or on an individual basis, that limited matter may proceed in court, but the remainder of this section shall remain in effect.

15. Severability

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. Where possible, an unenforceable provision shall be replaced by an enforceable provision that most closely reflects its original intent, including the intent to limit the Operator's liability to the greatest extent permitted by law.

16. No Waiver

No failure or delay by the Operator in exercising any right under these Terms shall constitute a waiver of that right. No waiver of any provision shall be effective unless in writing, and no such waiver shall constitute a continuing waiver of any subsequent breach.

17. Entire Agreement

These Terms, together with the Privacy Policy, the acknowledgment, and, where applicable, The Covenant, constitute the entire agreement between you and the Operator regarding the service, and supersede all prior or contemporaneous understandings and agreements on that subject.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes take effect upon posting to this page. Your continued use of the service after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using the service.

19. Governing Law and Venue

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. To the extent any dispute is not subject to arbitration, you agree that it shall be brought exclusively in the courts of competent jurisdiction applicable to the Operator, and you consent to the personal jurisdiction and venue of such courts.
